TrimKit User Agreement

1. Agreement to these Terms
These Terms of Service and User Agreement (the "Agreement") form a binding contract between you and Luke Tsiaras, doing business as TrimKit governing your access to and use of the TrimKit website at trimkit.app and related services (the "Service"). By clicking "I Agree," creating an account, or otherwise using the Service, you confirm you have read and agree to be bound by this Agreement and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. The Service is not directed to children. By using the Service you represent that you meet this requirement and have capacity to enter this Agreement.
3. Description of the Service
TrimKit is an AI visualization tool. You upload photos of yourself ("Selfies") and reference images of a desired haircut ("Reference Images"). The Service uses third-party generative AI to produce simulated images of how the haircut might look on you ("Generated Images"), to help you communicate a style to a barber or stylist. Generated Images are artistic AI approximations for visualization only — not photographs, predictions, or guarantees of any actual result.
4. Accounts and Security
Some features require an account (email + password or supported third-party sign-in such as Google). You are responsible for your credentials and all activity under your account. We confirm new accounts via a one-time emailed code; keep your email secure. Notify support@trimkit.app of unauthorized use.
5. Biometric and Facial Data — Notice and Consent
- What we collect: Selfies contain facial images, which may be "biometric"/"special category" data. We analyze facial and hair characteristics from your Selfies.
- Why and how long: solely to create your Generated Images. We retain Selfies up to 48 hours after generation, then delete them; Generated Images up to 30 days, then delete. Longer only if legally required.
- What we do NOT do: we do not sell, lease, trade, or profit from your facial/biometric data; we do not use your content to train AI models; we do not disclose biometric data to third parties except the AI processing provider strictly necessary to deliver the Service, under confidentiality.
- Your consent: by uploading Selfies and clicking "I Agree" (or "Generate"), you give explicit, informed consent to this processing.
- Withdrawing consent: you may withdraw anytime by deleting your content, closing your account, or emailing support@trimkit.app; withdrawal does not affect prior processing and may prevent providing the Service.
6. Your Content and License
You retain ownership of your User Content (Selfies and Reference Images). You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and transform it only to operate the Service and generate visualizations, for the retention periods in Section 5. We claim no ownership of your User Content.
7. Reference Images and Third-Party Rights
You represent and warrant you have all necessary rights/permissions for every image you upload and that doing so violates no one's privacy, publicity, or IP rights. The Service analyzes Reference Images only to extract the haircut style — not to identify or recreate any other person's facial identity. You are solely responsible for images you upload.
8. Acceptable Use
You agree not to: upload images of any person without consent; upload unlawful, infringing, harassing, hateful, sexual, or abusive content; upload images of minors; use the Service to identify, surveil, or impersonate anyone; misuse, scrape, reverse-engineer, or circumvent security/rate-limits; or resell/commercially exploit the Service without written permission. We use automated and manual moderation and may remove content or suspend accounts.
9. Credits, Subscriptions, Billing, and Renewals
- Credits: the Service runs on credits; each generation consumes a fixed number. Credits have no cash value, are non-transferable and non-refundable except as required by law, and may expire as below.
- Free generation: one (1) free generation per account, one time only.
- Plans (auto-renewing): Weekly $1.99/week → 200 credits/week (do not accumulate past a 400-credit cap; unused credits remain until spent or the plan ends); Yearly $49.99/year → 10,000 credits, reset each renewal. Prices exclude applicable taxes (e.g., VAT), added at checkout.
- Automatic renewal: your subscription automatically renews at the then-current price and charges your payment method until you cancel; renewal terms are disclosed at purchase.
- Cancellation: cancel anytime in account settings / billing portal; it stops future renewals at period end. Cancellation is as easy as sign-up.
- Refunds: except where required by law, payments are non-refundable (see Section 10). Payments are processed by Stripe; we do not store full card details.
10. EU/UK Consumers — Right of Withdrawal
EU/UK consumers normally have a 14-day right to withdraw from a distance contract for digital services. By purchasing a plan or using credits, you expressly request immediate provision of the digital service and acknowledge you lose the withdrawal right once the service is fully performed (e.g., once you use credits to generate images). To the extent not yet performed, you may withdraw within 14 days via support@trimkit.app or the cancellation control in your account. Non-waivable statutory rights are unaffected.
11. Intellectual Property
The Service, its software, design, and the TrimKit name and logo are owned by Luke Tsiaras, doing business as TrimKit and protected by IP laws. Except for rights expressly granted, no rights transfer. You may use Generated Images of yourself for personal, non-commercial purposes (such as showing your barber).
12. Third-Party Services
The Service relies on third-party providers (AI generation, authentication, hosting, payment, email, security), whose terms may also apply. We are not responsible for third-party services we do not control.
13. Disclaimers
THE SERVICE AND ALL GENERATED IMAGES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant Generated Images will be accurate, realistic, or suitable for any purpose, or that the Service will be uninterrupted or error-free. Nothing excludes liability that cannot lawfully be excluded.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Luke Tsiaras, doing business as TrimKit AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE PRIOR 12 MONTHS, OR (B) USD $100. Some jurisdictions do not allow certain limitations.
15. Indemnification
You agree to indemnify and hold harmless Luke Tsiaras, doing business as TrimKit and its affiliates from claims, damages, or expenses (including reasonable legal fees) arising from your User Content, your breach of this Agreement, or your violation of any law or third-party right — including any claim that an image you uploaded infringed another person's rights.
16. Termination
You may stop using the Service and delete your account anytime. We may suspend or terminate access for violations or to protect the Service or users. Sections that by nature survive (e.g., 5, 6, 11, 13–17) survive termination.
17. Changes
We may modify the Service or this Agreement. For material changes we will give reasonable notice (e.g., posting an updated Agreement with a new effective date and, where appropriate, requesting renewed acceptance). Continued use after changes take effect constitutes acceptance.
18. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-laws rules, except that the arbitration provisions below are governed by the Federal Arbitration Act.
Agreement to Arbitrate. Except as set out below, you and Luke Tsiaras, doing business as TrimKit, agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the Service (a "Dispute") will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. YOU AND TRIMKIT EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class-action waiver is found unenforceable as to a particular Dispute, that Dispute (and only that Dispute) will proceed in court instead of arbitration, and the rest of this arbitration agreement remains in effect.
Exceptions. Either party may bring an individual claim in small claims court instead of arbitration if it qualifies, and either party may seek injunctive relief in court to protect intellectual property or confidential information.
Opting Out. You may opt out of this arbitration agreement by emailing support@trimkit.app within 30 days of first accepting this Agreement, stating your name and that you opt out of arbitration. If you opt out, this Section's arbitration and class-waiver provisions do not apply to you, and Disputes will instead be brought in the state or federal courts located in Suffolk County, Massachusetts, where you and TrimKit consent to personal jurisdiction and venue.
Mandatory consumer-protection rights in your country or state of residence are unaffected.
19. Miscellaneous
If any provision is unenforceable, the rest remains in effect. Failure to enforce is not a waiver. You may not assign this Agreement without our consent; we may assign it in a merger or sale. This Agreement and the Privacy Policy are the entire agreement regarding the Service.
